Introduction and acceptance

These Terms of service (the “Terms”) are the agreement between you and the operators of Swatted.how (“Swatted”, “we”, “us” or “our”). They govern your access to and use of the Swatted website, the Swatted dashboard, the Swatted Discord server and bot, and every related feature we make available. Together we call these the “Service”.

Please read these Terms carefully. By creating an account, verifying a Discord identity, signing in, or otherwise using the Service, you confirm that you have read these Terms, that you understand them, and that you agree to be bound by them. If you do not agree, do not create an account and do not use the Service.

These Terms work together with two other documents that are part of this agreement and apply to you in the same way:

our Acceptable use policy, which sets out in more detail what you may and may not do with the Service; and
our Privacy policy, which explains what data we process about you, why, for how long, and the choices you have.

If one of those documents conflicts with these Terms on a specific point, the stricter rule applies to your conduct, and these Terms control everything else.

Swatted exists to help people understand exposure: what kinds of information about an identifier can surface, what that looks like, and what to do about it. It is built to be accountable. Every account is tied to a verified Discord identity, usage is limited, and activity is logged. Those choices are deliberate, and many of the rules below exist to protect them. We would rather be clear and firm than leave room for doubt, so this document is long. Where a plain summary helps, we give one.

Definitions

These words have the following meanings wherever they appear in these Terms:

Account means the Swatted account you register with an email address and password, together with everything linked to it, including your verified Discord identity, sessions, trusted devices, recovery codes, search history and reveal history.
Discord identity means the permanent Discord user ID you link to your Account during verification. It is the numeric ID Discord assigns to your Discord account, not your display name or username, which can change.
Swatted server means the official Swatted Discord server, where verification, device approvals, support and moderation take place.
Search means a new lookup you run in the dashboard for a username, email address, phone number or IP address, including a prefix of one.
Result means a record that matches a Search, shown in masked form until you reveal it.
Reveal means the action of spending one reveal credit to display the full contents of a single Result to you.
Credits means the reveal allowance that comes with your plan. Credits are a usage measure only. They are not money, they are not property, and they have no cash value.
Dataset means the collection of records the Service searches, as described in section 8.
Staff means the people who operate and moderate Swatted, including site administrators and moderators in the Swatted server.
Your content means anything you submit to us, such as search queries, removal requests, appeals, support messages and feedback.

Words like “including” and “for example” introduce examples. They do not limit the general statement that comes before them.

Changes to these terms

Swatted is an early product and it will change. We may update these Terms to reflect new features, changes in how the Service works, feedback we receive, advice we are given, or legal and safety requirements. When we do, we will change the “Last updated” date at the top of this page.

If a change is material, meaning it meaningfully reduces your rights or increases your obligations, we will also give you notice before it takes effect. We may do that with a notice in the dashboard, an announcement in the Swatted server, or both, as described in section 26. Where we reasonably can, we will give you at least 14 days of notice. Changes that are needed for safety, security or legal reasons, or that only affect new features, may take effect immediately.

Your continued use of the Service after an updated version takes effect means you accept it. If you do not agree with a change, stop using the Service and delete your Account from the Account page. Changes will not apply retroactively to conduct that took place before they took effect.

We may also change the Service itself. We may add, change, limit or remove features, change limits, or retire parts of the Service. We try to announce meaningful changes in advance, but we cannot promise that any feature will stay the same or remain available.

Eligibility

You may only use Swatted if all of the following are true:

You are at least 18 years old.
You are able to form a binding contract, and nothing in the law that applies to you prevents you from using the Service or from agreeing to these Terms.
You have a Discord account in good standing, you are able to join the Swatted server, and you are allowed to use Discord under Discord’s own terms.
We have not previously banned you, disabled you and asked you not to return, or removed an Account of yours for breaking these Terms or the Acceptable use policy.
You are using the Service for yourself, as an individual, and not on behalf of anyone else.

By using the Service you confirm that you meet these requirements. If you stop meeting any of them, you must stop using the Service. If we learn or reasonably believe that you do not meet them, we may suspend or close your Account under section 14. If we learn that an Account belongs to someone under 18, we will close it.

Swatted accounts are personal. Organisations, teams and businesses may not register an Account, and you may not create an Account for another person, even with their permission.

Your account

To use Swatted you create an Account with an email address and a password of at least 8 characters. Your Account stays inactive until you verify a Discord identity, as described in the next section. You must give us a real email address that you control, and you must keep it up to date.

One person, one account

You may hold only one Account.
Each Account can be linked to exactly one Discord identity, and each Discord identity can be linked to exactly one Account. The Service enforces this: a Discord identity that is already linked cannot be linked to a second Account.
You may not create additional Accounts, use additional Discord accounts, or ask anyone else to create an Account for you, whether to get more searches or credits, to get around a restriction, or for any other reason.

Your account is yours alone

Your Account is personal to you and is not transferable. You may not sell, rent, lend, share, give away or otherwise transfer your Account, your credentials, your credits or access to the Service. You may not let anyone else use your Account, even for a single search, and you may not use anyone else’s.

You are responsible for activity on your account

You are responsible for everything that happens under your Account, whether or not you authorised it, unless it happened because of a failure on our side. That is one reason the Service gives you tools to see and end active sessions and to remove trusted devices. If you believe someone else has accessed your Account, revoke your sessions and trusted devices from the Account page right away and tell us, using the contact route in section 27.

Accurate information

Everything you tell us about yourself must be true and not misleading. You may not register with an email address that belongs to someone else, use a disposable identity to hide who you are, or impersonate any person or organisation.

Discord verification and server membership

Discord verification is how Swatted keeps every Account accountable. It is not optional, and it is not a one-time formality. It is a continuing condition of access.

How verification works

You join the Swatted server.
In the dashboard you receive a single-use activation code. Each code expires 15 minutes after it is issued, and requesting a new code cancels the old one.
In the server’s verification channel you use the Swatted bot’s “Verify account” button and paste your code.
The bot links your permanent Discord user ID to your Account, your Account becomes active, and you are given the verified role in the server.

When you verify, you authorise us to store your Discord user ID, and to keep a cached copy of your Discord username, display name and avatar so we can show your linked identity to you. You can also sign in with Discord. When you do, we request only Discord’s basic “identify” permission, which tells us who you are on Discord. Signing in with Discord does not give us access to your messages, your other servers or your contacts.

You must stay a member of the Swatted server

You must remain a member of the Swatted server for as long as you use the Service. If your linked Discord account leaves the server, or is removed from it, your Account is suspended automatically. When that happens every active session on your Account is signed out, and you cannot search or reveal until membership is restored.

If you rejoin the server with the same Discord account, access is restored automatically, as long as your Account is not also banned, disabled or deleted. A membership suspension on its own is not a penalty. It is simply how the Service works.

Changing or unlinking your Discord identity

You cannot unlink or replace your Discord identity yourself. If you need to, for example because you have lost access to your Discord account, contact Staff. Staff may ask you to prove that you own the Account, and may refuse a request that looks like an attempt to evade a restriction or to move an Account between people. When a Discord identity is unlinked, your Account returns to an unverified state, your Discord sessions and trusted devices are revoked, and you may be removed from the server until you verify again. Records of the change are kept.

Discord moderation mirrors site moderation

Swatted and the Swatted server are moderated together. If your Account is banned, your Discord account may be banned from the server. If your Account is temporarily disabled, your Discord account may be timed out or given a restricted role for the same period. If you are banned from the server, you will generally also lose access to the Service.

Account security, device approval and recovery codes

We build security into the Service, but security is shared work. You agree to keep your Account secure and to use the protections we give you.

Your password

Choose a strong password that you do not use anywhere else, and keep it secret. We store only a secure hash of your password, never the password itself. Sign-in attempts are rate limited to slow down guessing.

New device approval

When you sign in from a browser that is not a trusted device, the Service may ask you to approve the sign-in from Discord. The Swatted bot sends you a direct message with Approve and Deny buttons. An approval request expires after 5 minutes. Only approve a sign-in that you started yourself. If you receive a request you did not expect, deny it and change your password.

You can choose to trust a device when you approve it. A trusted device can skip approval for about 30 days, after which approval is required again. You can see and revoke your trusted devices and your active sessions at any time from the Account page. Sessions expire on their own after 30 days.

Because approvals arrive as Discord direct messages, you need to allow direct messages from the Swatted server, and you need to share the server with the bot. If you block the bot or close your direct messages, you may not be able to sign in on new devices.

Recovery codes

You can generate a set of 10 recovery codes from the Account page. They are backup proof that the Account is yours if you lose access to your Discord account.

Each code works once. A used code cannot be used again.
We show the codes only once, when you generate them. We keep only a secure hash of each code, so we cannot show them to you again or tell you what they were.
Generating a new set replaces the old set completely. Old codes stop working at once.
Account recovery requires your email address, your password and one valid recovery code. Recovery confirms that you own the Account. It does not by itself move the Account to a different Discord identity. That step stays with Staff.

Store your recovery codes somewhere safe and offline, such as a password manager. Treat them like passwords. If you lose both your Discord access and your recovery codes, we may not be able to restore your Account.

Your security obligations

Do not share your password, recovery codes, activation codes or session with anyone.
Do not approve a sign-in you did not start.
Revoke sessions and devices you do not recognise, and tell us promptly about any suspected compromise.
Do not try to weaken, bypass or test the security of the Service, including device approval, rate limits or sessions, except as allowed in section 12.

The service

Swatted is a private, account-based dashboard for looking up exposure. This section describes what the Service does today, so that you know exactly what you are agreeing to use.

The Dataset

The Dataset is compiled from data sets that we assemble. Records vary in age, accuracy and completeness. A Result may be out of date, incomplete, or inaccurate, and the presence or absence of a Result is not a guarantee of anything. You must treat every Result as a lead to verify independently, not as established fact about any person.

You are responsible for how you use Results. Presenting a Result to anyone as verified fact, or relying on one to make a decision about a person, is done at your own risk and may breach these Terms and the Acceptable use policy. The Service is provided for lawful, authorized lookups only, as set out in section 12.

Search

You can search for a username, an email address, a phone number or an IP address. The Service detects the type of query, and you can also search by a prefix of a value.
Every new Search counts against your daily search allowance, including a Search that returns no Results.
Results are shown in pages of 25. Moving to the next page of the same Search does not count as a new Search.
Before you reveal a Result, the username, email address and phone number on it are shown in full, because they are what you searched for. The password and the IP address stay masked. A Result may also show a label for the source it belongs to.

Reveals

A Reveal spends one credit and displays the full contents of one Result to you. A Reveal is a display of information inside your Account. It is not a sale, a licence or a transfer of any information, and it gives you no ownership of or rights in any record. If a request to reveal the same Result is retried because of a network problem, the Service is built so that you are charged only once.

Revealed records and history

Records you have revealed stay available on your Revealed page, so you can find them again without spending another credit. Results you have already revealed are also marked when they appear in a later Search.
Your search history shows the Searches you have run, when you ran them, the query type, how many Results they returned and how many Reveals came from each.
Search history is kept for security and abuse prevention. You cannot delete it, edit it or hide it. See section 13.

Your data tools

You can export your own data at any time from the Account page. The export includes your profile, linked Discord identity, usage, search history, reveal history, credit history, sessions, trusted devices and removal requests.
You can delete your Account from the Account page, as described in section 14.
You can ask for information that describes you to be removed, as described in section 19.

What Swatted is not

Swatted is not a background check, a people search, an identity verification tool or an investigative service. You may not use the Service, or anything you see in it, to make decisions about any person, including decisions about employment, housing, credit, insurance, education, tenancy or access to any service. You may not use it to find, locate, contact, monitor or learn about a specific person.

Plans, credits and limits

Usage limits keep the Service fair, make abuse expensive, and are part of how Swatted stays accountable. They are enforced on our servers. Nothing you do in your browser can raise them.

The Free plan

Every Account is on the Free plan, which currently includes:

20 Searches per day.
3 reveal credits per day.
9 reveal credits per week.

A Reveal costs 1 credit. The daily and weekly reveal limits apply at the same time, so the number of Reveals you can make right now is whichever of the two has less left. For example, if you have used 8 of your 9 weekly credits, you can make only one more Reveal this week, even on a new day.

When limits reset

All limits run on Coordinated Universal Time (UTC), whatever your local time zone.
Daily limits reset at 00:00 UTC every day.
Weekly limits reset at 00:00 UTC every Monday.
Your Account page and the dashboard show what you have used and what you have left.

Short-term rate limits

In addition to the daily and weekly limits, the Service applies short-term rate limits to searching, revealing, signing in and signing up. If you hit one, wait a moment and try again. Rate limits are a safety measure, not an allowance, and deliberately working around them is prohibited.

What credits are

Credits are a measure of how much you may use the Service. They are not money, not a stored value, not a token and not property, and they have no cash value.
Unused credits do not roll over. Your allowance simply refreshes when a limit resets.
Credits cannot be sold, transferred, pooled, gifted or exchanged, and they cannot be refunded.
Credits end when your Account ends, for whatever reason it ends.

Changes to limits

We may change plan limits, including lowering them, to protect the Service or respond to abuse. We may also restrict an individual Account’s usage while we investigate a concern. We will show the current limits on the Pricing page and in your dashboard. Any attempt to evade limits, for example through automation, multiple Accounts, shared Accounts or manipulated requests, is a serious breach of these Terms.

Preview plans and future billing

The Pricing page shows paid plans, currently called Premium and Heist, with prices and planned features. These plans are previews. They are marked as not yet active, billing is not connected, and there is nothing to buy. We do not accept payment for Swatted today, and nobody is authorised to sell you Swatted access, credits or plans on our behalf.

Preview plans show what we are considering. They are not an offer, and the prices, names, limits and features shown for them may change or never launch. You cannot rely on a preview plan as a promise of any feature or price.

If we introduce paid plans in the future, we will present the full terms that apply to them before we charge you anything. That includes the price, what the plan includes, how and when you will be billed, how renewal and cancellation work, and any refund rights you have. Nothing will be charged unless you actively choose a paid plan and agree to those terms at that time. The rules in these Terms, including the limits on sharing, resale and automation, will continue to apply to paid plans.

Acceptable use

You must use Swatted lawfully, responsibly and only for its intended purpose: understanding exposure and how to reduce it. Our Acceptable use policy is incorporated into these Terms and forms part of this agreement. In short, it prohibits:

harassment, stalking, doxxing, threats and intimidation of any person;
using the Service or its Results to gain unauthorised access to accounts, devices, networks or systems;
automated scraping, bulk querying, and evading rate limits or usage limits;
reselling, renting or sharing your Account, or running more than one Account;
attempts to de-anonymise, re-identify, profile or target individuals; and
any use that is unlawful where you are, or that infringes the rights of others.

The next section sets out prohibited conduct in more detail. A breach of the Acceptable use policy is a breach of these Terms, and we enforce both in the same way.

Prohibited conduct

The following conduct is prohibited. The list is not complete. We may treat anything with the same effect or purpose the same way, and we decide what counts as a breach in our reasonable judgement.

Harm to people

Harassing, stalking, bullying, threatening, intimidating or abusing anyone.
Doxxing: collecting, publishing, sharing or threatening to share information about a person in order to expose, shame, frighten or endanger them.
Swatting, or any attempt to cause an emergency, police, medical or other response against someone on false grounds, or helping, encouraging or joking about doing so.
Using the Service, or anything you see or learn in it, to plan, support or carry out any real-world harm, including violence, extortion, blackmail, fraud, identity theft, sextortion or intimidation.
Trying to identify, locate, contact, track, monitor or target any real person, whether or not you think a Result relates to them.
Encouraging, recruiting or helping anyone else to do any of the above.

Misuse of results

Presenting a Result, or anything derived from it, as real information about a real person.
Copying, publishing, posting, distributing or compiling Results outside the Service, including in screenshots, lists, pastes, channels or files shared with others.
Combining Results with other information in order to build a profile of a person, or to link identifiers together.
Using Results to try to sign in to, reset or take over any account, device or service.

Automation, scraping and volume

Using bots, scripts, crawlers, headless browsers, browser extensions or any other automated means to access the Service, run Searches or make Reveals.
Scraping, harvesting or bulk downloading from the Service, or calling its internal APIs directly.
Bulk querying, including running long lists of identifiers, systematically working through prefixes or ranges, or any pattern of use designed to extract the Dataset or large parts of it.
Building, training or improving a database, product, model or service using anything obtained from Swatted.

Accounts and limits

Sharing, lending, renting, selling or buying Accounts, sessions, credits or access.
Reselling the Service or its output, or offering “lookups” or any similar service to others on the back of your Account.
Creating or using more than one Account, or using more than one Discord identity, for any reason, including to get more searches or credits.
Circumventing or attempting to circumvent limits, rate limits, credits, masking, device approval or any other control, for example by manipulating requests, replaying or altering requests, or coordinating with other users.
Evading a ban, disable or suspension by creating a new Account, using a new or different Discord identity, using someone else’s Account, or asking someone to act for you.

Security and integrity

Reverse engineering, decompiling, disassembling or otherwise trying to extract the source code, models, algorithms or data of the Service, except to the extent the law expressly allows this despite this restriction.
Probing, scanning, load testing, penetration testing or otherwise testing the security of the Service, the Swatted server or the Swatted bot without our prior written permission given through the contact route in section 27.
Accessing or trying to access any Account, data or part of the Service that you are not authorised to access, including administrative areas.
Interfering with or disrupting the Service, its infrastructure or other users, including by introducing malware, overloading systems or attacking the Swatted server or bot.
Using the Service to send spam or unsolicited messages, including through the Swatted bot.

Honesty

Impersonating Swatted, Staff, the owner, Discord or any other person or organisation, or falsely implying that you are connected with any of them.
Giving false information to us, including in a removal request, an appeal or a support conversation.
Submitting a removal request for information that does not describe you, in order to abuse the process.

If you discover a security vulnerability by accident, stop immediately, do not access or keep any data, and report it to us privately using the contact route in section 27. We will not take action against good-faith reports that follow this approach.

Monitoring, logging and enforcement

Swatted is accountable by design, and that means we keep records. By using the Service you accept that the activity described below is logged and can be reviewed.

What we log

Every Search you run, including the query itself, the query type, the time and the number of Results.
Every Reveal you make and every credit you spend.
Security events, such as sign-ins, device approvals and denials, sessions, trusted devices, recovery code use and changes to your Discord link.
Moderation actions taken on your Account, and removal requests and their status.
Activity and connection data, as described in our Privacy policy.

Search history and security records cannot be deleted by you. They exist so that misuse can be detected, investigated and proven, and so that decisions can be reviewed fairly. Audit and moderation records are kept even after an Account is deleted, for as long as described in our Privacy policy.

How we use these records

We may review activity on any Account, at any time, to operate and secure the Service, to enforce limits, to detect patterns of abuse such as automation, bulk querying, shared Accounts or ban evasion, to investigate reports, and to respond to appeals. Staff may review Account activity from the admin area or from the Swatted server.

Investigations

If we suspect a breach of these Terms, we may investigate. While we do, we may restrict, disable or suspend the Account involved. We may ask you to explain your activity. We are not required to tell you everything we know, how we detected it, or who reported it.

Where we reasonably believe there is a risk of harm to a person, or where we are required to, we may preserve records and share relevant information with the appropriate authorities. We treat threats of violence, swatting and similar conduct with the seriousness they deserve.

Reporting misuse

If you believe someone is misusing Swatted, tell us through the contact route in section 27, with as much detail as you can. Reports are handled privately. Please do not post allegations publicly in the Swatted server.

Suspension, disabling and termination

We want every legitimate user to keep their Account. We also have to act when the rules are broken. This section explains the ways access can be limited or end, and what you can do about it.

Account states

Unverified. Your Account exists but has no verified Discord identity. You cannot search or reveal until you verify.
Membership suspended. Your linked Discord account is no longer in the Swatted server. This is automatic, is not a penalty, and ends automatically when you rejoin, as described in section 6.
Temporarily disabled. Staff have disabled your Account for a set period. While it is disabled you are signed out and cannot use the Service. The Account status page shows a countdown to when access returns and, where one was given, the reason. When the period ends, access is restored automatically unless another restriction applies.
Banned. Staff have permanently removed your access to the Service. You are signed out, and the Account status page shows the ban and, where one was given, the reason. A ban overrides any temporary disable.
Deleted. You have deleted your Account, or we have closed it.

When we may act

We may disable, suspend, restrict, ban or close your Account, with or without notice, if:

you breach these Terms or the Acceptable use policy, or we reasonably suspect that you have;
your use creates a risk of harm to any person, to other users, to Swatted or to the Service;
you no longer meet the eligibility requirements in section 4;
we are required to by law, by a court or authority, or by a provider we depend on, such as Discord;
your Account appears to be compromised, and restricting it protects you or others; or
we stop offering the Service, or the part of it you use.

How we respond depends on how serious the conduct is. For a minor or first issue we may warn you or disable the Account for a short time. For serious conduct, including anything involving harm or threatened harm to a person, doxxing, swatting, automation, resale or ban evasion, we may ban the Account immediately and permanently, without a warning first. We may also ban or restrict any other Account or Discord identity we reasonably believe belongs to or acts for the same person.

What happens to your data

If your Account is disabled or banned, we keep your records, including your search history and moderation history, so that the decision can be reviewed and so that repeat abuse can be recognised. Actions on your Account are also mirrored in the Swatted server, as described in section 6.

Appeals

If you believe a disable or ban was a mistake, you can appeal. Start from the appeal page, and follow the contact route in section 27. Tell us the email address on your Account and explain, briefly and honestly, why you think the decision should change. We review appeals in good faith, but we are not obliged to reverse a decision, to give you a detailed explanation, or to reply within a particular time. Creating a new Account while an appeal is open is ban evasion and will end the appeal.

Deleting your account

You may stop using Swatted at any time, and you may delete your Account from the Account page. Deletion is permanent. When you delete your Account:

your email address and password are scrubbed from the Account, and it can no longer be used to sign in;
all of your sessions are signed out;
your Discord identity is unlinked, the verified role is removed, and you are removed from the Swatted server;
any remaining credits are lost; and
security, search and audit records may be kept for a limited period, as described in our Privacy policy, so that abuse can still be investigated.

If you want a copy of your data, export it before you delete your Account. Deleting an Account does not undo a ban and does not entitle you to a fresh start. A banned person may not return with a new Account.

What survives

When your Account ends, the parts of these Terms that by their nature should continue will continue. That includes the prohibitions on misuse of anything you saw in the Service, our rights to keep and use records as described above, and the sections on intellectual property, disclaimers, limitation of liability, indemnity and disputes.

Your content and feedback

Your content stays yours. You keep whatever rights you have in the search queries, removal requests, appeals, support messages and other material you submit to us.

So that we can run the Service, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process and display your content for as long as we need to operate, secure and improve the Service, enforce these Terms, handle your requests and meet our obligations. This includes keeping search queries in your history and our logs as described in section 13. This licence continues after your Account ends for as long as we are entitled to keep those records.

You are responsible for your content. You confirm that it is lawful, that it is accurate, and that it does not:

include anything you do not have the right to share;
include another person’s personal information unless you have a legitimate reason and a right to share it;
threaten, harass or defame anyone; or
include malware or anything designed to interfere with the Service.

Feedback

We welcome ideas, suggestions and bug reports. If you send us feedback, you agree that we may use it freely, without any obligation to you, including to improve Swatted. We are not required to use any feedback, and sending it does not give you any rights in the Service.

Our intellectual property and your licence

The Service, including its software, design, interface, text, graphics, the Swatted name, the Swatted.how wordmark and logo, the Dataset and the way it is compiled, and the Swatted bot, belongs to us or to our licensors. It is protected by intellectual property laws. Except for the limited licence below, these Terms do not give you any right, title or interest in any of it.

Your licence to use Swatted

As long as you follow these Terms, we give you a personal, limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to access and use the Service through its normal interface, for your own personal and lawful use. This licence ends automatically when your Account ends, or if you breach these Terms.

What the licence does not allow

copying, modifying, distributing, selling or leasing any part of the Service or the Dataset;
creating derivative works from the Service or from Results;
removing, hiding or changing any notice, label, masking or branding;
using our name, logo or wordmark in a way that suggests we endorse you or are connected with you; or
anything else prohibited in section 12.

We reserve all rights that these Terms do not expressly grant to you.

Third-party services

Swatted relies on services run by other companies, and some parts of the Service only work through them. The most important is Discord.

Discord

Verification, sign-in with Discord, new device approval, the Swatted server, the Swatted bot, support and moderation all run on Discord. Your use of Discord is governed by Discord’s own terms and policies, not by ours, and you must follow them. We do not control Discord. If Discord is unavailable, changes how it works, restricts the Swatted server or bot, or restricts your Discord account, parts of the Service may stop working for you or for everyone, and we are not responsible for that.

Infrastructure providers

We use hosting, networking, security and storage providers to run the Service. Your traffic may pass through them, and they may process data on our behalf, as described in our Privacy policy.

Links

The Service may link to websites or services we do not operate, including links shown on Results. We do not control them, we are not responsible for their content or practices, and a link is not an endorsement. You use them at your own risk and under their own terms.

Privacy

Our Privacy policy explains what data we process about you as a user of Swatted, why we process it, how we protect it, how long we keep it, and your rights and choices. It is part of this agreement. Please read it.

In short: we process the account and operational data needed to run an accountable service. That includes your email address, a hash of your password, your Discord identity, your search and reveal history, security events, removal requests, and activity and connection data. We use it to operate the Service, keep it secure, enforce limits and these Terms, and respond to your requests. Search history cannot be deleted by users, and some records are kept after deletion for a limited period, as the Privacy policy describes.

The data we process about you as a user is a separate matter from the records that appear in search Results.

Removal requests

If you find information in Swatted that you believe describes you, you can ask us to remove it. You can do that from the removal request page while signed in, where you can refer to a specific record, or with the removal command in the Swatted server.

Each request gets a reference number, such as REM-000123, so you can follow it up.
We review every request. We may contact you privately to confirm that the information really concerns you before we act.
If your Account has a verified Discord identity, the Swatted bot may send you a direct message when the status of your request changes.
Removal requests are handled privately and are never posted publicly.

You must only request removal of information that describes you, and everything you tell us in a request must be true. Using the removal process to harass someone, to test the Service, or to find out what the Dataset holds about another person is prohibited.

Disclaimers

We work hard to make Swatted useful, secure and reliable. But we have to be clear about what we can and cannot promise.

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory. We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and quiet enjoyment, and any warranties arising from a course of dealing or usage.

In particular, we do not promise that:

any Result is accurate, complete or current, or that it correctly relates to any person, account or device. Records vary in age and quality and may be out of date, incomplete or wrong;
a Search that returns no Results means that an identifier has never been exposed anywhere, or that one that returns Results has been;
the Service will meet your needs, or that it will help you prevent any particular risk;
the Service will be available at any particular time, or that it will be uninterrupted, timely, secure or free of errors, bugs or harmful components;
any feature, plan, limit or preview will continue to be offered; or
any data you keep in the Service, including your history, will be preserved, other than as set out in our Privacy policy.

Nothing in Swatted, including anything on the Protect yourself page, is legal, security or professional advice. If you have a real security concern, talk to a qualified professional and to the provider of the affected account.

Some places do not allow certain warranties to be excluded. Where that is the case, the exclusions above apply only to the extent the law allows.

Limitation of liability

This section limits what we are responsible for if something goes wrong. Please read it carefully. It applies to the maximum extent permitted by the law that applies to you.

We are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, reputation or opportunity, arising out of or in connection with these Terms or the Service, even if we were told such loss was possible.
We are not liable for any loss or damage caused by your breach of these Terms, by anyone using your Account, by your reliance on any Result, by Discord or any other third-party service, or by events outside our reasonable control.
We are not liable for how any other user behaves, on or off the Service, although we will act on reports of misuse as described in section 13.
Our total liability to you for all claims arising out of or in connection with these Terms or the Service, whatever the legal basis, is limited to the greater of the amount you paid us for the Service in the 12 months before the event that gave rise to the claim, and $50. Swatted is free today, so in practice the second figure applies.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited. That includes, where the law provides for it, liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for gross negligence or wilful misconduct. Nothing in these Terms affects rights you have as a consumer that cannot be waived by contract.

Indemnity

You agree to defend, indemnify and hold harmless Swatted, its operators, Staff and service providers from and against any claims, demands, losses, liabilities, damages, costs and expenses, including reasonable legal fees, that arise out of or relate to:

your use or misuse of the Service, or of anything you saw or obtained in it;
your breach of these Terms or the Acceptable use policy;
your content, including anything you submit in a removal request or appeal;
your violation of any law or of the rights of any other person; or
any activity under your Account that results from your failure to keep it secure.

We may take over the defence of any matter covered by this section, and if we do, you agree to cooperate with us. You may not settle any such matter in a way that places an obligation on us without our written consent. This section applies to the extent permitted by the law that applies to you.

Force majeure

We are not responsible for any delay or failure to perform that is caused by events outside our reasonable control. Those include outages or changes at Discord, hosting or network providers, failures of the internet or of power or telecommunications, cyberattacks and denial-of-service attacks, natural events, fire, flood, epidemic, war, terrorism, civil unrest, labour disputes, and actions or orders of any government or authority. If such an event happens, we will take reasonable steps to limit its effect and to restore the Service.

Disputes

Talk to us first

Most problems can be solved with a conversation. If you have a complaint or a dispute about Swatted or these Terms, you agree to contact us first, using the route in section 27, and to give us a clear description of the problem and what you would like us to do.

Informal resolution period

After you contact us, we will both try in good faith to resolve the matter informally for at least 30 days. Neither of us will start formal proceedings during that period, unless it is necessary to prevent imminent harm, to protect a person’s safety, to preserve evidence, or to stop a limitation period from running out. Taking part in this process does not mean either of us gives up any rights.

If we cannot resolve it

If the matter is not resolved within the informal resolution period, either of us may pursue the remedies that are available under the law that applies. Any claim must be brought individually. To the extent the law allows, you may not bring a claim as a representative of, or as a member of, a group or class of users.

Your consumer rights

Nothing in this section, or anywhere in these Terms, takes away any mandatory consumer protection that you are entitled to under the law of the place where you live, including any right you have to bring a claim before a court or authority there.

General terms

Assignment

You may not assign, transfer or delegate these Terms, your Account, or any of your rights or obligations under them, to anyone. Any attempt to do so has no effect. We may assign or transfer these Terms, in whole or in part, including as part of a reorganisation, merger or sale of the Service, provided that your rights under these Terms are not reduced as a result.

Severability

If any part of these Terms is found to be invalid, illegal or unenforceable, that part will be limited or removed only to the minimum extent necessary, and the rest of these Terms will remain in full force. Where possible, the invalid part will be replaced with a valid provision that comes as close as possible to its original intent.

No waiver

If we do not enforce a right or a provision of these Terms, or we delay in doing so, that does not mean we give it up. A waiver only counts if we give it in writing, and a waiver of one breach is not a waiver of any other breach.

Entire agreement

These Terms, together with the Acceptable use policy and the Privacy policy, are the entire agreement between you and us about the Service. They replace any earlier agreement, understanding or statement about it, including earlier versions of these Terms. If we introduce paid plans, the terms presented to you for them will form part of this agreement too.

Relationship

Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and us. You have no authority to act for us or to bind us in any way. Nobody other than you and us has any right to enforce these Terms.

Headings and language

Headings, summaries and the table of contents are there to help you read. They do not change the meaning of these Terms. If we provide a translation, the English version applies if the two differ, unless the law that applies to you requires otherwise.

Notices

We may give you notices about the Service or these Terms in any of these ways, and a notice is effective as soon as it is shown or sent:

through the Service, for example a message on your dashboard or on the Account status page;
in the Swatted server, for example an announcement in a public channel; or
by a direct message from the Swatted bot to your linked Discord account.

It is your responsibility to stay a member of the Swatted server and to keep direct messages from the server open, so that notices can reach you. Notices you send to us must go through the contact route in the next section. We do not accept notices by email.

Contact

Swatted does not offer email support. All contact happens on Discord, which is also where your identity is verified. To reach us:

Join the Swatted Discord server using the server invite.
Send a direct message to the owner, Discord user ID 1318214074198265997.

Discord only lets you send a direct message to someone you share a server with, so the message will only go through once you have joined the Swatted server. Check the user ID before you send anything. Anyone else claiming to be the owner, or offering support through another channel, is not us.
